BUYER BEWARE of Tax Credit

 

The first time homebuyers tax credit of $8,000 has been approved by HUD for all FHA loans. But don't get too excited too quickly. If you get a chance to read the mortgagee letter, ML 2009-15, it states that you can't use this tax credit for the required down payment of 3.5%.

HUD originally put out mortgagee letter 2009-15 on May 12th, but was rescinded the next day. Please read about that here : $8,000 tax credit rescinded by HUD. For some reason, it was prematurely placed on HUD's web site, but apparently wasn't finalized. Now we have a new version and if not read correctly, you could be putting misinformation out there. So what does the new mortgagee letter state?

 

 

 

Here is the positive part about the tax credit. You can receive the first time homebuyers tax credit upfront, but not through the IRS.  This would be illegal. Please read : It's illegal to receive your tax credit before you close on your homeBuyers - BEWARE, please read that, because too many people are saying that you can get the money directly from the IRS prior to closing. The IRS & HUD both say no!!!

So how can you receive this upfront?  It can be given to you as a second or a silent second from any Federal, State, or local agencies, and any FHA mortgagee or any FHA approved non-profit organization.  People, in layman's terms, this is already acceptable by HUD's standards, except for the lender that is now able to give the monies upfront in a form of a 2nd mortgage. Another terminology is that this can be an advance loan from any of the entities mentioned above.

 

 

 

Summary :  Essentially, this means that the entities mentioned above, are purchasing this tax credit on your behalf and giving it back to you. The short version of this is that you can use some of the money from the $8,000 Tax Credit as your down payment, but after you put down the first 3.5% of that down payment. Meaning, you have to come up with 3.5% of your own money still. With FHA loans, it can still be a gift from a relative/family member.  It also can come from non-profit or government agencies to be used as your initial down payment, but not used through the tax credit. Overall, the tax credit that is advanced, can be used for all closing costs. But you can't receive monies back at closing. 

And again, keeping in mind, it's illegal to receive this tax credit upfront directly from the IRS. There is more verbiage in the mortgagee letter 2009-15 , but the main point is that you have to have 3.5% of the downpayment yourself, before you can use the tax credit that would be 'loaned' to you.

 

 

THOUGHTS??? - Well, in all honesty, how does this truly help? What is the gov't thinking here? As a buyer, I would still need the initial 3.5% of my monies for the down payment. Again, needing money to buy. I know some of you are for this fact, that buyers should have skin in the game. But keep in mind, this was not the true demise to our foreclosure mess. We need to sell houses to keep this economy going.  Just my opinions and food for thought.  thanks

Short Sale Buyers MUST be Flexible......And Enjoy the Savings !!!

 

rubber manTo be a good candidate as a short sale buyer....You absolutely, positively, without a doubt

       If you....Ms/Mr. Selling Agent have a sense that your buyer has some urgency....can't make arrangements for temporary housing, can't prolong a lease or close even earlier than anticipated (yes we DO have some short sales that close EARLY ) then do everyone a favor.....the seller, the listing agent, the title company, the lenders - for your buyer....the one or more for the sellers....do EVERYONE a favor and don't even write the offer.

    Know this....everyone ELSE who chooses to be involved in a short sale transaction...has bothered to get to know the process, to make the investment to take the training...who is willing to prepare a package AND a closing file...one closing file that would have been 20 some pages is now a Short Sale package with over a hundred and sometimes over 200 pages of documented material...."gets it"....they know there is likely to a bump here or there..that the exact day could be earlier...could be a little bit later....leave your ego at the short sale door...

    Short sales are never all about you....Mr./Mrs Buyer - Buyer's Agent....the process involves too many players to be all about any individual....If patience is not your virtue of choice....if you can't change your plans...can't go from hurry up to wait ....do everyone a favor who has hoped so much, who has worked so hard.....don't go there and leave the short sale buying to the buyers who have the flexibility and patience with a purchase and the understanding of the process.....Thank you !

The "Yeah Buts..." of Short Sales....

 

 

Upside down House We have a gorgeous Short Sale listing ...barely lived in...finished lower level...outstanding kitchen...3 car attached garage and an out building any man would kill for to call his "own cave" complete with power, heat and water...it is just the best....and at price point that will make you want to calculate your mini-mortgage payment immediately.  We have had one agent who  has taken the same buyers through three times....and another twice.

    We stay in touch with both agents especially when yet another agent expresses serious interest. The conversation with the "two time" agent with many, many years experience went like this....

       Agent: Is there more than one mortgage on this short sale ?

       US: The number of mortgages shouldn't matter to your buyers...do they like the house ?

Agent: Well, you know if there is more than mortgage, you will never close the deal and my buyers will            have wasted all that time waiting for something that will never happen.

        US:  Short sales are a specialty part of our practice....with the exception of one...ALL of them have had

               at LEAST 2 liens.....And we closed a commercial short sale with SEVEN liens....and a flock of both

                attorneys and investors.....it is about experience and education...the number of liens doesn't

                matter to us as long as we have done our homework and know what they are when we take the

                listing.

Agent: Oh....in that case, we will go ahead and have our buyers get estimates on the things they want         to do to make the house "their own."

         US: GREAT !  We are happy to help with local contractors and some ideas that the sellers had explored as

                            well   as pricing for those ideas....!

upside down house  We met with a potential short sale seller today....his home had been listed by an agent who knew that the listing price was less than the amount owed on both the mortgage and the HELOC....and that the sellers did not and would not have the financial means to bring money to closing....in short, the sellers were short...it was a short sale....just not called that in MLS...just not explained that way to the sellers.  What exactly is a short sale...how does it work, what will happen...What did the other realtor mean he wouldn't tell me what happens until we get an offer ?

      I have no idea....I have no idea how a licensed realtor could be so irresponsible...less than ethical...dare I say dishonest ?  Who takes a listing and tells the sellers "later" what will happen....?  And what will happen if at the over priced asking price you DON'T get an offer....

 Know this...you don't save money by hiring a discount realtor....a short sale is the best thing you never paid for if you are upside down and have missed payments on your home.  Call a CDPE. Short Sale Tales...We have our House Listed...BUT....

   We got a call from a homeowner who fits the "distressed" description...beyond description...as does the agent who has the property listed currently.  The property has been on the market for over 200 days...for less than is owed and is not listed as a short sale ...the homeowner says that the agent has not ever even mentioned, explained, discussed the definition of short sale with him...HUH ?

  The property description and the comments to the agents in MLS make no mention of the property being a short sale....and oh surprise...it isn't priced like one either !   The agent is a discount agent...I  am not picking on agents who choose to practice and offer less service for less money....that IS their choice...and the choice of homeowners who choose to list with them.

.   HOWEVER.....ethically, morally....every other "LY" I can think of...SCREAMS....

                                            KNOW WHAT YOU DON'T KNOW...

   I am not  one to say...always this and never that...and no one should....but think twice...we get that distressed (people who owe more than the market will pay) homeowners are looking for a way to minimize their losses...or maybe they believe that using a discount brokerage will "make them whole"...and they will be able to walk away with pocket change or at the very least break even....OH NOT ...at least not usually.

   Every agent....regardless of their profile...full service...discount, minimum service....self service... deserves to be paid for what they do. 

  If an agent is listing or more/MOST importantly SHOULD /MUST list a home as a short sale  because the market clearly dictates that the list price is less than is owed AND as importantly that the homeowner(s) qualify as short sale candidates....It is unlikely the agent has the education, experience and can't possibly be paid for the time it takes to list and successfully close a short sale.

   Homeowners - If you are upside down and owe more than the market will pay for your home...Call a CDPE with Successful Short Sale Experience.  IT COSTS YOU NOTHING !!

   Call us...no matter where you are in the country...we will find someone qualified to short sale your home...the credit, the sleep, the stress you save WILL be your own...

  We took a little chill time last night visiting one of our buyers...and out for dinner....then a walk thru the maill to walk off dinner....and suddenly...my husband experienced sharp chest pain, arm tingling...hot sensation....and quickly got him reclining on a bench inside the mall while I dialed 911 on my cell.  It what seemed like a blink of an eye...rescue squads came from both Greendale and Greenfield.  It seems (was there a full moon ?) there were a few reasons for people in need at the same time.  The paramedics were professional...prompt...drove me to our car parked on the other end of the mall....and were very caring in their approach to us both.

    David has now spent the night at St. Luke's and is having more precautionary tests done. We know healing is taking place as I write....and that some things will change..less sodium, more exercise...and so it goes..you never fully appreciate your health until it gets called into question....

   Thank you Greendale and Greenfield...we appreciate your service and know that your prompt and professional action go a long way to making us all feel better.

A Time to Remember..The Clouds are Crying

rain clouds  In Wisconsin, Memorial Day is the first holiday where there is any hint of warm weather...you will find every greenhouse and nursery buzzing with customers...it's a tradition...you dare not plant anything before Memoria Day or risk the chance that a last frost will destroy that pansy, daisy, petunia bloom and you will be forced to start over with another batch of heartier plants set to survive the summer.

   I can't remember a Memorial Day weekend in a lifetime in Wisconsin when it didn't rain.. It got the ground softer for planting..it dampened the spirits a little for the children watching the parade...it moved the picnic from the backyard to the garage or rec room....but maybe, just maybe from the "everything happens for a reason" school of thought...it is because it is reminder from a higher source....a reminder that while it is a "time off"....a 3 day weekend...a start of the festival season...what it REALLY IS.....

    A while ago the word from the neurosurgeon was that back surgery was the order of the day for what appeared to be an incurable pain in my lower back. Couldn't stand, sit or walk...sleep...without being in pain...could only hope tylenol would bring the sandman...hot showers, cold packs....nothing brought relief.  I was resigned to back surgery and then a friend of ours suggested I make an appointment with Bill Anderson....I am up for anything when it comes to curing pain. If you want to call it, alternative medicine...Magic Fingers...I am there !Shaman

  Bill's training is varied....extensive....and may be "outside the box" of any sort of treatment you have had before...and that is the good news...the very good healing news.  If you click Bill's brief resume above...you will see his title of "healer"....and nothing could be closer to the truth...I almost crawled into the office....and skipped out ! Has it Become TOO Much...Just about the Money ?

  Yesterday. I went to  see one one my very favorite physicians...Dr. Manfred Chiang...he is wonderful...compassionate, bright, cutting (he IS a surgeon) edge....he is truly the highest and best.  Last year in an attempt to permanently rid myself of what I thought was recurrent phlebitis...I had 3 laser vein treatments...with 2 more scheduled.  After 3, I was no better....and had other medical priorities that got in the way of doing the last two. I questioned the wisdom of 2 more when the first three had not produced any noticable result. Plane rides, desk sitting, webinars, seminars are all forbidden activities without a pillow, pain...most likely both.Dr. Chiang

   Soooo...off I go to see if a stripping of what I believed was a vein problem would improve my "sitability"...Dr. Chiang is big on education....he explains everything.  His/my very successful lapband surgery for me a year and a half ago is why I am no longer diabetic ! As he moved the monitoring device over my now lotioned thigh...I told him how I thought the screen resembled an old black and white TV between channels and how I couldn't see anything.TV Snow

 

 

  His well trained eye and gentle tone explained his probe was looking for the "black marbles" on the screen which would be the veins. I showed him where my recurrent and severe pain was and he ran the probe again and again....there was no vein there.... Physicians are careful not to critique one another's handiwork....but I have now learned that the 3 laser surgeries I had last year that produced no results were to treat a vein that was non-existent and not the problem.

     The laser surgeon did the same test...he never explained what he saw....and more importantly did NOT see...I will deal with this another way....but as with lots of other things...it came down to money...he sold me what I didn't want, didn't need...it was ...Money

    I am reminded of the duties we have to clients and customers...

  • Pricing a listing correctly....it's not what the want, need, "have to have"...it is what the market SAYS
  • Overlooking or minimizing issues as a buyer's agent which may become "larger than they appear" later
  • Whenever you make your goal  ALL about the Money....it's Not all about the buyer or seller...and that is not a good thing......Priorities...Ethics....

Short Sales...Make it Your Highest and Best !

  

 

upside down house  We promote our short sale listings and don't subscribe to the "the price will sell it don't promote it" theory....we respect that the sellers want to move  on with their lives...that the bank needs to get rid of the red ink...that the market doesn't need one more house for sale...and that marketing was my career in another lifetime..that more than one medium is more effective than any one media...

   If you list short sales...You have an obligation.....it's called...getting...

 

Highest and Best

   As a seller...it's important to you...just as it would be with any kind of transaction that your agent has an active and aggressive....and well monitored marketing plan....the foreclosure clock continues to run...and while as a seller you will not profit from the sale...you do need an agent steering your marketing to the fastest point of closure possible in the market.  

   As a buyer....writing for half price on an already reduced priced listing will end up killing another tree and wasting the energy required for using the fax....don't go there.

   As an agent.....if you aren't comfortable with the process...haven't done it successfully...read about it and not actively and successfully participated...don't experiment with people's futures..refer it and move on to an area in which you excel.

   Short Sales are not for everyone....If you list them, buy them, write on them...

Hidden Objects....May not be What or Where they Appear ....

 

Hidden Objects

 

Sometimes when my mind needs a rest from real estate....I like to play the Hidden Object games on the computer...few things are where you would expect them to be...the bird may be behind the refrigerator door and the clock in the tree....or the pen/pencil is cleverly disguised next to another horizontal or vertical line and it blends in with the graphic.  Or the challenge may be to find all of the....pawprints, stars, etc. scattered throughout the picture.

    Often, you can find life lessons in the leisure time activities that you are attracted to....if you turn the picture upside down....back away, get up closer...use the magnifying glass..open the blinds....use the key to drawer, you find the object that was hiding.

Short Sales are Like a Divorce.....

 We are currently at the "end stage" of several short sales...final approval with lenders to agree on the offers of the generous and patient buyers we have been fortunate to attract for our short sale sellers. As the back and forth "Yes Buts...." continued for the final attempts at squeezing every possible nickel and the closing dates creep closer, I thought how like a divorce a short sale really is in a number of ways.

 - The beginning of the relationship is euphoric...you plan a lifetime together.....or at least a good number of years.

- You know that you are accepting something (the house and mortgage) or someone (your spouse) that is less than perfect....but you are so in love you know the good outweighs the bad

- You depend upon the strength of the relationship to get you through the thick and thin times and know that if you work together, things will work out you took the vows and signed the papers "for better or worse."

Begins to crumble....

     For whatever reason, money...the lack of....communication...the lack of...priorities for the spouses become dramatically opposed......and divorce proceedings  commence..and the process can take months or years....and the arguments can drift to a petty level (he bought her the nail polish/eye shadow collection and he is taking it with him....)

And so it can go with Short Sales

    The lender wants more money than the home will appraise for...The agent is forced to point out the obvious on the sellers' upside down financial statement...The over burdened loss mitigator does not return calls or answer e-mails on a timely basis...finally there is judgement day...with the 2nd level, the supervisor, the vice president...and all evidence is presented again and updated. The relationship must be severed.

   And the divorce is granted....with last minute meetings on the courthouse steps...The short sale is approved with hours before the buyer walks...their ratelock expires...

And the Similarities Continue...

    Neither spouse got all they wanted.... and the custody agreement means no one gets the children as often as they wish..but they can now go their separate ways. 

    The bank took a hit on the mortgage and/or HELOC....and the sellers lost their equity....but they have avoided foreclosure...garnishment of wages and deficiencies that haunt them for a lifetime...and they can begin again in just a couple short years to have a house they can call home once again.

  Sometimes change just takes getting used to....like the toliet seat being up....the paper rolled from the back or the front...and then there is change for the sake of change...newer may not be better....ie

 

 

 

 

 I have tried being patient...I have re-booted you, talked nicely...lit candles...sought counseling...and done everything I could to salvage and re-build our relationship...you won't communicate...you remind me every other minute that you have stopped working.

   It takes two...and now I am finished, done...nada...zip...gone....when and if you find start working...send me an e-mail....till then....
