  There are some agents who have determined that the cure for their ailing sales in real estate is to have their buyers and sellers PAY for loyalty....Yes, I know...hard to believe....rubs my ethics the wrong way.....We all work for money.  It seems that for some people, somewhere along the way....to my way of thinking...got their priorities shuffled. Yes, we all need to make a living....BUT when we start charging for Buyer Agency....Charging a Distressed Home Owner an Up Front Fee for listing a Short Sale...because that BUYS the loyalty of the those poor misinformed buyers and sellers....is it about THEM ?

    When you make THEM your top priority....that first time buyer sooo excited about a new home and you walk them thru the process and teach them the things to look for in value, inspection, lending...contractors....That distressed, depressed seller who want have to face garnishment of his/her salary because you did a successful short sale.

 I spoke with someone yesterday who knew 2 people with homes in foreclosure that did not know about or understand the merits of a Short Sale. The homes were listed for more than they would ever appraise for because the listing agents BOUGHT the listing. They listened to the homeowner....they made a list of what the seller owed including mortgage payments for which they were behind...added commission, maybe a sprinkle of back taxes and topped it all with a "little bit extra" to start over and then put the house on the market for this inflated price....to the seller, this was the only way that they could leave the property debt free.....NOT THE CASE !

   If you are behind on payments, have lost your job, are getting divorced, your mortage rate adjusted...have become disabled or have some combination of these situations or other hardship...a short sale may be your solution.  THERE IS NO COST TO THE SELLER FOR A SHORT SALE.  In a short sale, the seller is also not allowed to profit...so while no profit is made...there is also no expense !  If anyone tries to approach you as a seller and suggests a fee of ANY kind...RUN do not walk away as quickly as possible.  You should never pay anything as a seller for a short sale.

Short Sale Tales Part 35 "Of Course I Know Short Sales...."

Upside Down House   We recently got a call from an agent who was going to show one of our Short Sale listings for the second time.  In Wisconsin at this point in time....not everyone understands Short Sales. That everyone includes realtors, attorneys,....and of course buyers and sellers.  I asked the showing agent if she and her buyer understood short sales.  Invariably the answer is the same..."Of course." You bet...of course....because you know you probably SHOULD know....but you don't....so see if you can fake it with the lister....maybe I just list them and don't know either...oh not !  The next question was interesting..."Have you asked the bank how many days it will take them to accept the offer?"    Oh sure....and then I asked them if they were sending ME a closing gift instead of invariably cutting commission.  There is no shame in saying you don't know.....you are not completely familiar.....could the listing agent please explain....and hopefully the lister DOES get it...CAN explain it.  Unfortunately as much as I wish every lender was just sitting there waiting for me to send them a short sale package...there are hundreds of files on every Loss Mitigator's Desk. It is the job of our team to see that our package is put together well...written well, received promptly and that we know the mitigator and the mitigator knows us....and our sellers' property.

Short Sale Tales Part 34 Real Estate With Compassion....

Upside Down House  Some people have the very much mistaken impression that if a home is being sold as a Short Sale, the sellers must be dead beats...financially irresponsible Know Nothings.....No ambition to get a "real job"....Those people with THOSE THOUGHT PATTERNS ARE WRONG....Unfortunately,it has been our experience that some of THOSE people are Realtors !!!!

  •      There are lots of reasons for hardship and more in a soft economy than there might be otherwise. Hardship is the reason for a short sale. Some examples that we have come across in the Short Sale part of our practice include:

                                 * Unemployment, reduced hours or compensation

                                 * Divorce

                                 * Job Relocation

                                 * Illness

                                 * Death or a parent or spouse

                                 * Forced Early Retirement

                                 * Adjustable Rate that adjusted beyond the ability to pay

                                 *Option Arms or "pick a payment" loans when the lowest payment was

                                     chosen too often due to financial condition

                                 * Overwhelming Medical expenses - loss of insurance due to job loss

Agents....when you leave showing report...when you are with your buyers...know that the condition of the house is the condition the sellers can afford...and if you are dealing with a listing agent that knows HOW to do Short Sales....and has not just READ about it.....the house is priced to sell...the sellers are in some sort of hardship situation...recognize it, be compassionate and understanding. Buyers know that the sellers are doing the best they can due to whatever their hardship circumstance and the patience you show while waiting for the lender's approval will be rewarded with the home you want at a price you would not normally pay.

The other day I got a call from an appraiser....she wanted to know why I would price a"perfectly good" property that had closed recently for a little OVER ASKING as I did.....all the other homes in the area had been $20,000 or more than our listing had been listed for...for what appeared to be fewer updates, worse condition, etc. I asked her to look at the days on market....."Oh....your listing sold MUCH faster !" No...it wasn't a short sale...or a foreclosure...it was a home in good condition...that we staged, had freshly painted, had "all dressed up and ready to sell....including the price !"  "We price to sell...not to sit !" I told her.....the phone got quiet...."I guess you're right," she mumbled quietly....and why wouldnt you....? The longer a home sits....the less the price...so why not try and get it right the first time !

 The more short sales that we do....and the more we are educated about doing them....the more horror stories we hear about Realtors who were responsible for taking homeowners into foreclosure....or sometimes, short sale status, If the home would have been priced to sell...priced at what the comps showed the price should be....the seller may have made no or little profit...BUT they would not be in a short sale or foreclosure position.   They listened to the seller, they whine....they "needed" they money...oh Pulllllleeez....if you were an experienced, make that ETHICAL realtor you would know....and maybe you DID know that the house would never ever appraise for that "Wishful thinking" price for which you listed the property.

                                        It doesn't seem to matter what brokerage the agent is with...it can among the largest....or the smaller discount brokers.....it is apparently anyone who either doesn't bother to do a NET PROCEEDS SHEET...or doesn't care....OR doesn't know how to do a short sale.....OR just plain doesn't get it....unless you have a cash buyer who doesn't care about the value of the property and doesn't get an appraisal...there is ZERO opportunity for the house to be sold at the price the seller "needs."

     REALTORS.....be HONEST....if you have not had significant education (not a mention at a sales meeting and been passed a form to fill out or glanced at an addendum your company may have prepared) DO NOT ATTEMPT A SHORT SALE OR YOU WILL HAVE WHAT SHOULD BE GUILT FOR TAKING A SELLER INTO FORECLOSURE. MANAGERS AND BROKERS....DO YOU HAVE ANY IDEA THE RISK THAT YOU PLACE SELLERS AT WHEN YOU ALLOW AGENTS TO LIST SHORT SALES OR PROPERTIES THAT BE SHORT SALES ???   Last night we got to see democracy at work....we got to see that every voice matters....that if you want a voice in city government....step up to the microphone...it matters.

   A  couple members of the city council....the department of public works.....spent tens of thousands of the tax payers hard earned money hiring outside engineering firms to conceive a variety of designs...the sidewalks went across the back of the lots of a number of homes...ours included....we don't want the additional six foot intrusion....and none of the neighbors did either. The council members who wanted the sidewalks romanticized them calling them sidepaths...bike paths....side ways...everything but what they are...sidewalks that need to be maintained, repaired, replaced, swept and shoveled...if not at the taxpayers' expense.....then at some point, when budgets get tight....as they are already...then the taxpayers who had adjacent property would most probably be expected to maintain them.....we just said NO....we had buttons printed, we printed brochures, we circulated petitions, we e-mailed the council, we encouraged neighbors to attend public works and council meetings....we networked....we just said no....THANK YOU ...Aldermen - Ament, Harenda, Hopkins and Wysocki...the people spoke and you listened....you know citizens most affected didn't want side walks, paths, ways....to pay for additional equipment and labor...or buy more of our own equipment and furnish the labor...

   There were people who wanted us to believe the decision had been made...it was all part of a master plan and we were powerless to change it.....It wasn't true....We didn't want to fight city hall...we just wanted them to listen...and happily they did ! 

   Don't complain about what you cannot change....work to change it !


Short Sale Tales Part 33 Desperate People Price Desparately

Upside Down House   Whenever we have a listing appointment...Short Sale or Not and don't get the listing....you always want to know WHY....is there something we could have said or done differently that would have changed the outcome ? Did we omit something in the presentation that another agent used....Was it too long, too short....The answer for us, 99.9% of the time is always the same....we wouldn't BUY the listing....we didn't tell the sellers that they don't really have to short sale their home after all...it just needs the right promotion, our dynamite marketing plan....a video tour, more internet exposure, an additonal open house......THEN we can sell it for a price that will profit the seller, pay off the mortgages and liens and everyone will live happily ever after.

Stop Sign on Slope  Consider this PLEASE  Mr./Mrs./Ms Seller....If I could sell your house for more money...why wouldn't I do that ?  Realtors work on commission...Good realtors that are full service invest a lot in your listing...signage, photography, websites, networking, a marketing plan with promotion....If I could make MORE to recapture my costs...WHY wouldn't I do that ?  I have overhead personal and professional every month....I have a mortgage...I have to keep a car running...health insurance....etc., etc., etc....WHY WOULD I CHOOSE TO MAKE LESS MONEY ?

Sellers....lead with your head....not your heart....it's time to face the difficult part...your house will NOT sell for the price you had in mind, wished it would, thought it could, has not yet.  You have a wonderful home...we know you invested a lot of time, money and yourself in getting it to be the home you wanted it to be....and now it is time to move on....and sell it for what it needs to sell for...the only number it will appraise for.... Interview  The question....that tells you the very most you will need to know in making a decision on which realtor to choose is:  "What was your list to sale ratio for the last year and how many (if required) price reductions did that average ?"

    If an agent has a handle on the market...has done her/his/their homework...they know how to price a home...AND if the market takes a slide AFTER a home is listed (not before and the agent bought the listing for whatever he/she/they thought it would take to get the business) ...the price has to slide with it.....Knowing how to price a listing, then following thru with a monitored marketing plan is the key to putting a sold sign out........

Price is Right  Don't Play games with agents who Play "Buy Your Listing at ANY Price"...Know that their experience is what counts to get your home sold.
